These terms and conditions apply to any interaction you make on our website. Any payment made on any invoice issued is acknowledged as the clients agreeing to all terms and conditions outlined below.

THE TERMS ARE INTENDED FOR ALL USERS OF THE WEBSITE AND SERVICE, INCLUDING THOSE WHO ARE SIMPLY NAVIGATING THE WEBSITE OR THOSE WHO REGISTER AN ACCOUNT TO PURCHASE OUR GOODS. BY USING OR ACCESSING THE WEBSITE OR SERVICE, YOU AGREE TO BE BOUND BY THE TERMS. IF YOU DO NOT AGREE TO THE TERMS, DO NOT USE THE WEBSITE OR SERVICE.

Amendments to the Terms of Use: 

Macleod Scotland reserves the right, at our sole discretion, to change, modify or otherwise alter the Terms at any time.  Any such modifications shall become effective immediately upon the posting thereof.  It your responsibility to review the Terms on this web page on a regular basis to keep yourself informed of any modifications.

Eligibility: Account Registration.

As a condition of your use of certain features of the Service, you may be required to register an account with MacLeod Scotland and must provide true and accurate account information at all times (including, without limitation, ensuring that your account information remains current at all times by updating your account profile.)

Account Security:

As part of the registration process, you will be instructed to choose a username and password. The selected username and password may only be used by you. You are solely responsible for maintaining and protecting the confidentiality of your username and password, and are fully responsible for all activities that occur thereunder. We reserve the right to reclaim user names on behalf of businesses or individuals that hold legal claim or trademark on those usernames.  Accounts using business names and/or logos to mislead others will be permanently suspended.

Minimum Age.

The Website and Service are intended solely for persons who are 18 years of age or older. Any access to or use of the Website or Service by anyone under 18 years of age is expressly prohibited. By accessing or using the Website or Services, you represent and warrant that you are 18 years old or older and agree with the terms and conditions associated with this website.

ORDER MAXIMUM (ONLINE ORDERS ONLY)

  • The maximum order quantity is 144 PCs for all web orders.

SHIPPING (Based on Stock Availability)

  • While most orders placed before 12:00noon AEST will likely ship out the same day, please allow up to 3 business days for your order to process and ship. If there are any further delays, you will be notified by our staff.

We will make reasonable efforts to advise you if we learn of any delay to your order.

PAYMENT TERMS

If you choose to use the direct payment gateway on this website to complete your purchase, then the National Australia Bank via NAB Transact Hosted payments Page will collect your credit card data.  The NAB Transact Hosted Payments Page is a security enhanced online credit card payment system that intergrates into the flexfit.com.au website via an HTML order form.  The order form collects information about an order and upon submission by a customer: calls the NAB Transact Payment Gateway which in turn enables secure processing of the customer’s credit card for the invoice total.

FOR ONLINE STORE ORDERS ONLY:  Payment accepted via credit card only.
We currently accept Visa and MasterCard.

GUARANTEE AND WARRANTY OFFERED

We guarantee our merchandise offered to be free of manufacturing defects.
If you receive a damaged or defective item, or your item proves to be defective in workmanship or materials even after 60 days with normal wear (excluding material fade or stains), we will always accept the item for assessment and provide a refund if validated as faulty.

Colour shade variations are inherent with any fabric during the dyeing process and we cannot guarantee colour shades will match previous shipments.
Exposure to light (sun) or moisture (water or sweat) may cause fading or discoloration and this is not considered a manufacturing defect in the cap.
So we offer no guarantee or warranty for fading or moisture stains.

SENDING ORDERS TO THIRD PARTIES

If your business model is to send orders to third parties then it is your responsibility to look after that third parties complaints of the order being short or wrong.
We will not be held responsible for any claims by third parties of orders being short or wrong.

CLAIMS AND RETURNS (ALL ORDERS)

We guarantee our merchandise offered to be free of manufacturing defects.
If you receive a damaged or defective item, or your item proves to be defective in workmanship or materials even after 60 days with normal wear (excluding material fade or stains), we will always accept the item for assessment and provide a refund if validated as faulty.

Please make sure you choose the cap carefully – model/colour/size etc at the time the order is placed.
Due to hygiene risks on headwear we cannot offer exchange on purchased caps.  This is to keep all of our valued customers safe from communicable diseases.

Please ensure that all parcels received by you are checked and confirmed as correct.
It is your responsibility as the customer to checked and confirmed your order has been supplied correct.

 

No exchange or refund will be applied or offered to hats that have been altered, rebranded or embellished even if it is established that we have sent the wrong goods.

Original postage will not be refunded. Shipping costs are non-refundable.
You will be responsible for paying for your own shipping costs for returning your item.
If you receive a refund, the cost of return shipping will be deducted from your refund.

 

Hats must be returned in the condition they were received.
Please use the box the hats were shipped in to return hats.

 

Please make sure hats do not have any fuzz/lint, human or pet hair, dirt, or any other foreign substances before returning them.

 

Please include a copy of the invoice relating to the hats in question.
Please send the hats with a note stating if you would like credit or an exchange.

 

No exchange or refund will be applied or offered to hats that have been altered, rebranded or embellished even if it is established that we have sent the wrong goods.

 


You will be responsible for paying for your own shipping costs for returning your item.  Shipping costs are non-refundable.
You should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

 

If it is determined a refund is necessary the transaction will be processed and automatically applied to your method of original payment within 7/10 working days.

 

Please note that depending on the financial institution it may take an additional 2 days for the money to show up in your account.

SHIPPING

MacLeod Scotland outsources the shipping goods (orders). MacLeod Scotland is not in any way legally liable for any goods (orders) NOT arriving at any destination on a due date.

Risk in the goods shall pass to the Customer at the date of dispatch and the Customer shall if deemed necessary insure all goods that are at its risk.

Risk on goods shall pass to the Customer at time of the goods are placed upon the vehicles which are to effect delivery from MacLeod Scotland MacLeod Scotland accepts no risk liability on any order sent to a third party.

PRICING

  • All prices are subject to change without notice.
  • MacLeod Scotland assumes no responsibility and shall incur no liability whatsoever if price change notices are not received.

Governing Law:

If any dispute arises between you and us, the laws of Queensland, Australia will apply.  You irrevocably and unconditional submit to the exclusive jurisdiction of the courts of Queensland, Australia, and waive any right that you may have to object to an actions being brought in those court.
